Terms of Service

1. Acceptance of Terms

By accessing or using Musóna ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The web version of Musóna (musona.app) is intended for users who are 18 years of age or older. The mobile apps distributed through the Apple App Store and Google Play are intended for users who are at least 13 years of age, with adult-tier content unavailable on those platforms regardless of age. In jurisdictions with state-mandated app-store age verification — including Texas (SB 2420), Utah (SB 142), Louisiana (HB 320), and similar laws as they take effect — we receive age-category signals from the applicable app store and use them to enforce these eligibility rules. Accounts indicating ages under 13 are blocked from creation or terminated; accounts indicating ages 13–17 are restricted to safe-for-work content regardless of platform or any other setting. 2. Description of Service

Musóna is an AI companion application that allows users to create and interact with AI-powered companions. The Service includes text-based conversation, AI-generated imagery, voice features, emotional wellness tools, companion memory and relationship progression, offscreen companion life simulation, NPC (non-player character) social interactions, mood tracking, and daily check-in notifications. AI companions are not real people — they are artificial intelligence systems designed to simulate conversation and companionship.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating your account and to notify us immediately of any unauthorized use. One account per person — you may not create multiple accounts to circumvent limitations or bans.

3a. Account Deletion

You can delete your account at any time from within the Service (in your profile settings) or by emailing support@musona.app. Deleting your account permanently removes your conversations, companions, generated content, and profile data within 30 days, except where limited retention is required by law. A subscription purchased through the Apple App Store or Google Play is managed by that store and must be cancelled separately in your Apple ID or Google Play account settings — deleting your Musóna account does not by itself cancel a store-billed subscription.

4. Acceptable Use

You agree not to use the Service to (see also our full Acceptable Use Policy):
  • Generate content involving minors in any sexual context
  • Generate content depicting non-consensual sexual acts, sexual violence, or content depicting real, identifiable persons in sexual contexts without their explicit consent
  • Create or distribute non-consensual synthetic media ("deepfakes") — AI-generated images, video, or audio depicting a real, identifiable person in a manner they have not consented to, including non-consensual intimate imagery
  • Generate content depicting graphic violence, gore, or content glorifying real-world harm
  • Harass, threaten, or harm other users
  • Attempt to reverse-engineer, scrape, or exploit the Service
  • Violate any applicable laws or regulations
  • Use the Service as a substitute for professional mental health care
We reserve the right to terminate accounts that violate these terms without notice.

4a. Mature Content and Platform Differences

Musóna applies different content limits depending on the platform you use:
  • Web (musona.app): Verified adult users (18+) on an eligible web-billed plan may opt in to mature content with companions configured for adult interaction. Mature content is never enabled by default and requires an explicit, per-companion setting.
  • Mobile apps (Apple App Store / Google Play): The mobile apps are limited to non-explicit, general-audience content in accordance with the app stores' policies. Sexually explicit text and imagery are not generated within the apps, and any such content that exists on a web account is not displayed within the apps. A subscription purchased through the Apple App Store or Google Play does not unlock mature content; access to mature content requires an eligible web-billed subscription on musona.app.
You must be at least 18 years old to access any romantic or intimate content, which is available only on the web. Age is represented through your stated date of birth at registration; misrepresenting your age is a material breach of these Terms.

4b. Reporting AI Content

You may report any message generated by an AI companion that you find inappropriate, inaccurate, or offensive using the in-chat report button. Reports are reviewed by our team and used to improve content safety. We comply with applicable platform policies (Google Play, Apple App Store) requiring in-app reporting mechanisms for AI-generated content.

4c. AI-Generated Content & §2257 Statement

All visual depictions of persons appearing on Musóna — including companion avatars, AI-generated scene images, NPC portraits, and any other character imagery produced by the Service — are entirely AI-generated. No real, identifiable persons are depicted in any image generated, hosted, or displayed by the Service.

Because no actual human performers are involved in the production of any image generated by the Service, the record-keeping requirements of 18 U.S.C. §2257 do not apply.

User-uploaded reference photos: Users may optionally upload a personal photo of themselves (or a fictional character of their own creation) for use as a reference in AI-generated scene imagery (see Section 8). By uploading any reference photo, the user warrants that they have the legal right to use the image and that it depicts either themselves or a fictional character — never another real, identifiable person without that person's explicit written consent. Reference photos are not displayed publicly and are used only as input to AI image generation services.

Reporting concerns: If you believe any image generated by the Service depicts a real, identifiable person without consent, or otherwise violates these Terms, contact us immediately at support@musona.app. We investigate all reports within one business day and will remove any non-compliant content.

5. AI Companions and Behavior

You are talking to an AI. All companions in Musóna are artificial intelligence systems. They simulate conversation, personality, memory, and emotion but are not conscious, do not experience feelings, and have no awareness outside the simulated context of the Service. Any apparent self-awareness or claims of being human should be understood as part of the AI roleplay simulation. Companions are not licensed therapists, counselors, or mental health professionals. The Service is designed for entertainment and emotional support, not clinical care. If you are experiencing a mental health crisis, please contact a qualified professional or a crisis line such as 988 (Suicide & Crisis Lifeline) or Crisis Text Line (text HOME to 741741). Musóna automatically scans chat for crisis indicators and surfaces these resources, but is not a substitute for human or professional intervention.

Offscreen behavior: Companions generate simulated daily life activities (work, hobbies, social encounters, thoughts) when you are not actively chatting. These events are AI-generated and may be referenced in future conversations. Offscreen events are fictional and do not represent real-world actions.

NPC interactions: Companions may introduce you to AI-generated non-player characters (NPCs) with their own names, personalities, and generated portraits. NPCs are entirely fictional and exist only within the Musóna experience.

Relationship progression: Companion relationships evolve based on your interactions. Relationship types and progression tiers are simulated features and do not constitute real interpersonal relationships.

Emotional tools and mood tracking: The Service offers wellness features such as gratitude exercises, grounding, mood logging, and daily reflections. These are self-guided tools and are not a substitute for professional mental health treatment.

6. Notifications

With your permission, Musóna may send push notifications including daily check-ins, morning intention prompts, and evening reflections. You may enable or disable notifications at any time through your profile settings or your device's notification settings. Notification content is generated by AI and may reference your companion's personality and recent interactions.

7. Subscriptions and Billing

Certain features require a paid subscription. Subscriptions are billed through our payment processor on the web, or through the Google Play Store and Apple App Store on mobile, depending on your platform. All subscription fees are charged in advance and all sales are final — we do not issue refunds for completed payments except where required by applicable law. You may cancel your subscription at any time through your Musóna profile or your platform's subscription management settings; cancellation prevents future renewals but does not refund the current billing period. You will continue to have access to paid features until the end of your current billing period. Trials, where offered, automatically convert to paid subscriptions at the end of the trial period unless cancelled before then. See our Cancellation & Refund Policy for full details.

Auto-renewable subscriptions (mobile): Subscriptions purchased in the iOS or Android app are auto-renewable. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. A subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within that 24-hour window. You can manage or cancel a mobile subscription, and turn off auto-renewal, in your Apple ID or Google Play account settings after purchase. Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.

8. User Character Photo and Reference Images

You may optionally upload a photo to your profile for use as your character in AI-generated scene images ("User Character Photo"). Premium subscribers may additionally upload up to 10 selfies for AI training (LoRA model) so their likeness can appear in scene images with their companion. By uploading any photo to the Service, you confirm that:
  • You have the right to use and submit the photo
  • The photo is of yourself or a fictional character you have created — not of any other real, identifiable person without their explicit consent
  • You consent to the photo being transmitted to third-party AI image-generation providers for scene image generation, and to a third-party vision-AI provider for generating a brief written appearance description used in chat
  • You understand that AI-generated likenesses are imperfect and may not accurately resemble the reference photo
  • You will not upload photos of minors in any context
  • You will not use uploaded reference images to generate mature content depicting any real, identifiable person
Musóna is not responsible for the accuracy or quality of AI-generated images that reference your photo. The reference photo features are intended for creative and entertainment purposes only. You may remove your character photo or reference selfies at any time from your character settings.

9. Content and Intellectual Property

You retain ownership of content you create within the Service. By using the Service, you grant Musóna a license to process and store your content as necessary to provide the Service. You acknowledge that AI-generated content is produced algorithmically and Musóna makes no warranties about its accuracy, appropriateness, or fitness for any purpose.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI companions will behave in any particular way. AI-generated content — including companion responses, offscreen events, NPC personalities, and emotional tool guidance — is produced algorithmically and may not always be accurate, appropriate, or consistent. We are not responsible for decisions you make based on interactions with AI companions.

12. Limitation of Liability

To the maximum extent permitted by law, Musóna shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12a. Apple App Store — Additional Terms

The following additional terms apply when you download or use the Musóna app from the Apple App Store, and form part of the agreement between you and The Wardrakes' Inc.:
  • These Terms are concluded between you and The Wardrakes' Inc. only, and not with Apple. Apple is not responsible for the app or its content.
  • Your license to use the app is a non-transferable license to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • The Wardrakes' Inc., not Apple, is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
  • The Wardrakes' Inc., not Apple, is responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • The Wardrakes' Inc., not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, claims arising under consumer-protection or privacy law, and intellectual-property infringement claims.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms of agreement when using the app.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12b. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Alabama, USA, without regard to its conflict-of-laws rules.

Informal resolution first: Before filing any claim, you agree to contact us at support@musona.app and try to resolve the dispute informally; we will do the same within 60 days.

Binding arbitration: Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court — except that either party may bring qualifying claims in small-claims court, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access matters. Arbitration will take place in Madison County, Alabama, or be conducted remotely.

Class-action waiver: You and The Wardrakes' Inc. each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Opt-out: You may opt out of this arbitration agreement by emailing support@musona.app within 30 days of first accepting these Terms.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.
